Does the EU AI Act apply to my company?

Yes, if you use any AI-powered tools such as ChatGPT, Copilot, AI features in your CRM, HR tools, or any other software with AI capabilities, you are a 'deployer' under the Act and Article 4 applies. This covers the vast majority of modern businesses.

What happens if we don't comply with the EU AI Act?

The AI Act sets no fine specifically for Article 4. Member States must set penalty rules for any infringement of the Act; in the Netherlands that law is still a draft, and it proposes an order to fix gaps, not a fine, for Article 4. The highest fines under the Act, for prohibited AI practices, reach EUR 35 million or 7% of global annual turnover; for SMEs the lower of the two applies.

Do we need certified training for EU AI Act compliance?

No. The AI Act requires no certified body and no specific course. Article 4 asks you to take measures that support your staff's AI literacy, suited to their knowledge and the AI tools they use. A record of those measures is how you show what you did.

What is Article 4 of the EU AI Act?

Article 4 of the EU AI Act requires providers and deployers of AI systems to take measures to support the development of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf. It does not require them to guarantee any specific level of AI literacy of any individual. The obligation has applied since February 2, 2025, was reworded by the Digital Omnibus on AI (Regulation (EU) 2026/1744) from July 27, 2026, and is supervised by national market surveillance authorities from August 2, 2026. In the Netherlands, the implementing law that appoints them is still a draft.
